Warranty
Cold Point Corporation warrants to the purchaser/owner, that all Cold Point Corp. manufactured products will be free from defects in material and workmanship under the normal use and maintenance.
The warranty coverage period:begins on the date of original installation through twelve (12) months for all components and sixty (60) months on the compressor.
Or
From the date of original sale through fifteen (15) months for all components and sixty-three (63) months on unit compressors, from the date of original sale. Whichever comes first.
What we will cover:
PARTS: Cold Point Corp. will replace any defective part that affects product operation or safety as determined by Cold Point Corp. with a new or rebuilt part at no charge. The replacement part then assumes the remaining portion of the warranty.
LABOR: Repair of defective units during the 12 month or 15-month warranty period requires Pre-Approval by Cold Point Corp. prior to any service work being performed. Labor will be reimbursed ONLY after Cold Point Corp.’s service department receives full model and serial number and approves a full and complete estimate of all warranty costs. Failure to submit complete information in advance will void reimbursement for labor costs.
Other Costs: Costs incurred for removing, installing, shipping, or handling of defective units are covered ONLY with written pre-approval from Cold Point Corp.
A return tag will be provided for requested warranty components being returned to Cold Point Corp.
What we do not cover:
Normal maintenance, damage, or repairs required as a consequence of faulty installation or application by others.
Failure to start due to voltage conditions, blown fuses, open circuit breakers, or other damage due to the inadequacy or interruption of electrical service.
Damage or repairs needed as a consequence of any misapplication, abuse, improper servicing, accident, unauthorized alterations or repairs, or improper maintenance or operation.
Damage as a result of environmental conditions, including but not limited to, floods, wind, fires, lightning, accidents, corrosive atmosphere, or other conditions beyond the control of Cold Point Corp.
Products installed outside the United States or Canada.
Any damage to person(s) or property of whatever kind, direct or indirect, special or consequential, whether resulting from use or loss of the product.
Limit of Warranties:
This warranty is exclusive and in lieu of any implied warranties of merchantability and fitness for a particular purpose and all other warranties express or implied. The remedies provided for in this warranty are exclusive and shall constitute the only liabilities on the part of Cold Point Corp. including any statement made by any individual which shall be of no effect.
Remedy Limitation: Cold Point Corp.’s sole obligation under the warranty is limited to, at Cold Point Corp.’s option, repair or replacement of the defective part or product. Cold Point Corp. is not responsible for any direct, indirect, special, punitive, incidental or consequential damages, including but not limited to loss of use, loss of revenue, loss of data, injury, business disruption, or property damage beyond the product itself.

Claim Procedure: Warranty service must be requested through Cold Point Corp. You will need to provide proof of purchase, installation date, model and serial number, and allow inspection by Cold Point Corp.
Dispute Resolution: If there is any dispute or claim arising from or related to this warranty, you agree to resolve it by confidential binding arbitration in Syracuse, New York, rather than in court, after first giving notice of the dispute with details to Cold Point Corp. and the opportunity to discuss resolution within thirty (30) days of such notice. The notice should be sent to the address for Cold Point Corp. set forth above. If after thirty (30) days, we are unable to resolve the claims, then either you or Cold Point Corp. may initiate arbitration proceedings.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages) and must follow this Dispute Resolution provision as a court would. YOU ACKNOWLEDGE THAT YOU ARE VOLUNTARILY AND KNOWINGLY FORFEITING YOUR RIGHT TO A TRIAL BY JURY AND TO OTHERWISE PROCEED IN A LAWSUIT IN STATE OR FEDERAL COURT.
The Federal Arbitration Act and federal arbitration law apply, and the American Arbitration Association (“AAA”) will administer the arbitration under its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes. Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s rules. The arbitrator will decide the substance of all claims in accordance with the laws of the state of New York including recognized principles of equity and will honor all claims of privilege recognized by applicable law. The arbitrator’s award shall be confidential, final, and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
CLASS ACTION WAIVER: YOU AND COLD POINT CORP. AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial. We also both agree that you or we may bring a suit in court to enjoin infringement or other misuse of intellectual property rights.
